Deep Space Exploration Society (DSES) gives notice that all of our development, which includes source code, schematics, and hardware designs, is available for the entire public, worldwide, to download from:
and possibly some githib or other sites related to our projects.
Our intent is for all of this work to be “Public Domain” under ITAR 120.11 and “Published” under EAR 734.7, and thus not subject to ITAR or EAR.
In addition, it is DSES’s policy not to provide services that might be restricted under ITAR or EAR, and we do not allow participation in our projects that could be connected with the national defense of any nation.
The ITAR/EAR strategy and policies of DSES are:
ITAR Strategy
ITAR is the International Trafficking in Arms Regulations. The sections of ITAR that concern us are 120 and 121. Various technologies are declared “munitions” which can not be exported to nations on an “embargoed list”, for example North Korea.
All items which are subject to DSES’s international collaborations carried out over the Internet are technical data under ITAR. This includes software as well as other information. Our ITAR strategy does not apply to physical objects but to their designs and the software which is part of them, which are technical data under ITAR.
DSES does not provide defense services. We do not answer questions or perform any requested services for individuals who are identified as asking for information to use for a military purpose for any nation, including the United States.
EAR Strategy
Regarding the Export Administration Regulations, DSES is concerned with keeping our work out of EAR definition “subject to the EAR”, which covers all things which are regulated under EAR. The EAR contains a carve-out to ITAR regarding published material.
Developer and Participant Policies
You must not participate in a DSES project, use any DSES facility, or participate in discussion using DSES mailing lists or other discussion facilities for the purpose of national defense. If you wish to use DSES software for purposes of national defense, don’t ask us for help. We are legally required not to provide it.
Individuals who are contributing to DSES development for immediate public disclosure, for a purpose other than national defense, may participate in DSES projects, regardless of their affiliation.
Individuals who are making use of DSES for reasons other than national defense may participate in DSES projects regardless of their affiliation.
Participation for national disaster preparedness and response (for example, by FEMA in the U.S. and many Amateur Radio organizations worldwide) is allowed and encouraged.
